{"id":22157,"date":"2018-09-12T11:05:15","date_gmt":"2018-09-12T14:05:15","guid":{"rendered":""},"modified":"2019-06-05T12:22:21","modified_gmt":"2019-06-05T15:22:21","slug":"contrato-de-experi-ncia","status":"publish","type":"post","link":"https:\/\/www.sinpro-rio.org.br\/principal\/contrato-de-experi-ncia\/","title":{"rendered":"Contrato de Experi\u00eancia"},"content":{"rendered":"<p>Deve ser tamb\u00e9m anotado na Carteira de Trabalho e sua dura\u00e7\u00e3o \u00e9 de, no m\u00e1ximo, noventa dias \u2013 art. 445 da CLT.<\/p>\n<p>O contrato de experi\u00eancia pode compreender v\u00e1rios per\u00edodos (30, 45, 60 dias etc.). Entretanto, o per\u00edodo de experi\u00eancia pode ser renovado somente uma vez, e desde que a soma dos dois per\u00edodos n\u00e3o ultrapasse o prazo m\u00e1ximo de noventa dias \u2013 art. 451 da CLT.<\/p>\n<p>Terminado o prazo de experi\u00eancia, permanecendo o professor no emprego, o contrato de trabalho passa a ser igual ao dos demais professores, isto \u00e9, um contrato por tempo indeterminado.<\/p>\n<p>Se o empregador romper o contrato de experi\u00eancia, dever\u00e1 pagar uma multa equivalente a 50% dos dias que ainda faltarem para seu t\u00e9rmino. Al\u00e9m dessa multa, o professor receber\u00e1 os dias trabalhados, o 13\u00ba sal\u00e1rio proporcional, f\u00e9rias proporcionais (acrescidas de 1\/3) e 40% do saldo do FGTS, que poder\u00e1 tamb\u00e9m ser sacado \u2013 art. 479 da CLT.<\/p>\n<p>Se, durante o per\u00edodo de experi\u00eancia, o professor achar que n\u00e3o deve permanecer no emprego, deve aguardar o \u00faltimo dia previsto para o encerramento do per\u00edodo de experi\u00eancia \u2013 art. 480 da CLT.<\/p>\n<p>Neste caso, professor, entregue no \u00faltimo dia um comunicado por escrito dizendo que n\u00e3o quer permanecer, protocolando na c\u00f3pia o recebimento. Agindo assim, voc\u00ea n\u00e3o ter\u00e1 que indenizar o empregador, cumprindo o per\u00edodo de aviso pr\u00e9vio, e receber\u00e1 os dias trabalhados e o 13\u00ba proporcional.<\/p>\n<p>Se n\u00e3o for poss\u00edvel esperar o t\u00e9rmino do contrato, a institui\u00e7\u00e3o poder\u00e1 cobrar indeniza\u00e7\u00e3o por rompimento antes do prazo (50% dos dias que faltarem para o seu t\u00e9rmino), que ser\u00e1 descontada dos dias trabalhados e do 13\u00ba proporcional (se o sal\u00e1rio for negativo, a rescis\u00e3o \u00e9 zerada) \u2013 art. 480 da CLT.
